Product Terms & Conditions and Refund Policy

By purchasing a digital product from The Scenic Studio, a brand of Leilah Claire Creative, LLC ("we," "us," "our"), you ("Buyer," "you") agree to the terms below. If you do not agree, please do not complete your purchase.
1. Nature of Purchase
Purchases made through our shop are for digital templates only. No custom design, editing, or personalized services are included with a shop purchase — you are buying a template license, not a done-for-you service. 2. What's Included / What's Excluded

The digital template(s) as listed in the product description
Not included:
Font licenses or font files — fonts referenced in the template must be sourced and licensed separately by the Buyer where required by the font's own terms (google fonts are typically free, canva fonts can be used in canva designs according to their terms)
Image files used in mockups or previews — these are for preview purposes only and are not part of your purchase unless explicitly stated (stock image resources can be supplied)
Any ongoing support, edits, or customization
3. Buyer Responsibilities
You are responsible for obtaining and paying for any tools, software, or subscriptions required to use the template (e.g., Canva, design software, or similar platforms). We are not responsible for compatibility issues with tools we do not control.
You are also responsible for saving and backing up your files after delivery. Delivery is made via email at the time of purchase; we are not obligated to re-send lost files after delivery has occurred, though we may choose to do so at our discretion.
4. Tax Responsibility
Applicable sales tax is calculated and collected at checkout through our payment processors, Flodesk and Stripe. Buyers are responsible for any tax obligations not automatically collected through checkout.
5. License Grant
Purchase of a template grants you a single business use license. This means:
The template may be used for one business only — yours, or a single client's.
No reselling, sharing, redistributing, or sublicensing of the template files, in whole or in part, whether modified or unmodified.
If you are a business purchasing on behalf of a client (e.g., a designer, VA, or agency), that use is permitted — but the license covers that one client only. Each additional client requires its own separately purchased license. A single purchase does not grant rights to reuse the template across multiple clients.
You may not claim the underlying template design as your own original work when used for a client, and you may not represent yourself as the creator of the base template.

6. Non-Transferability
The license granted under these terms is personal to the Buyer and may not be sold, assigned, gifted, or otherwise transferred to any other individual or business. This applies to the license itself, separately from the restriction on sharing or reselling the template files.
7. Intellectual Property
All templates, designs, and associated materials remain the intellectual property of The Scenic Studio. Purchasing a template grants you a license to use it under these terms — it does not transfer ownership, copyright, or intellectual property rights to you.
8. Unauthorized Use
Any use of a template outside the scope of this license — including but not limited to reselling, sharing files, using one license across multiple clients, or claiming authorship of the base design — is a violation of these terms. We reserve the right to:
Revoke access to the template and any related materials, and
Pursue legal action to enforce our rights and seek damages, where applicable.
9. Template Updates
We are not obligated to provide updates, revisions, or new versions of a template after purchase. We may choose to release updates at our sole discretion, but doing so does not create an ongoing obligation to continue doing so. If The Scenic Studio closes down, the creator will do their best within 14 days to let customers know so they can download their templates.
10. Screenshot & Recording Policy
Any tutorial videos, walkthroughs, or instructional content provided with your purchase are for your personal reference only. Buyers may not screenshot, screen-record, download, or publicly share (including on social media, YouTube, or other platforms) any tutorial or instructional video content provided by The Scenic Studio.
11. Accuracy Disclaimer
Templates are provided "as-is." We do not guarantee specific results, outcomes, or income from using our templates, and we make no warranties — express or implied — regarding fitness for a particular purpose. Some templates, freebies, and associated material content was created with the assistance of AI tools; while reviewed, you're responsible for reviewing and customizing any content to fit your own business before use.
12. Age Requirement
You must be at least 18 years old to purchase from The Scenic Studio.
13. Refund Policy
All sales are final. Due to the digital, instantly-deliverable nature of our products, we do not offer refunds, exchanges, or cancellations once a purchase is complete — this includes situations where you change your mind, purchase the wrong item, or do not end up using the template.
If you experience a technical issue accessing your files (e.g., a delivery error), contact us at hello@thescenicstudio.com and we'll work to resolve it.
14. Chargebacks & Payment Disputes
By purchasing, you agree not to file a chargeback or payment dispute with your bank or payment processor without first contacting The Scenic Studio directly to attempt to resolve the issue. Chargebacks filed without first reaching out may be contested using these terms and your order records as evidence of agreement to this policy.
15. Indemnification
You agree to indemnify and hold The Scenic Studio harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your violation of this Agreement or your misuse of a purchased template, including but not limited to unlicensed multi-client use, publishing, unauthorized sharing, or resale.
16. Dispute Resolution
Any dispute arising out of or relating to these terms or your purchase shall first be addressed informally by contacting The Scenic Studio at hello@thescenicstudio.com. If a resolution cannot be reached informally within 30 days, the dispute shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Forsyth, North Carolina, rather than in court, except that either party may bring an individual claim in small claims court where applicable. You and The Scenic Studio each waive the right to a jury trial and to participate in a class action.
17. Limitation of Liability
To the fullest extent permitted by law, The Scenic Studio's total liability for any claim arising from your purchase or use of a template is limited to the amount you paid for that template. We are not liable for indirect, incidental, or consequential damages, including lost profits or business losses.
18. Governing Law
These terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles, regardless of your location.
19. Changes to These Terms
We may update these terms at any time. Changes apply to purchases made after the updated terms are posted; they do not retroactively apply to purchases made prior to the update.
20. Severability
If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect.
21. Entire Agreement
These terms, together with our Digital Product License Agreement, constitute the entire agreement between you and The Scenic Studio regarding your purchase, and supersede any prior understanding not stated in writing here.
