First Class Design Experience Service Terms & Scope
The Scenic Studio | a brand of Leilah Claire Creative, LLC
Last updated: 08/12/2026
This Agreement governs the First Class Design Experience ("Service") offered by The Scenic Studio ("we," "us," "our," "TSS") to the client ("Client," "you") upon purchase. By purchasing a website template collection and enrolling in this Service, you agree to the terms below.
1. Scope of Service
The First Class Design Experience includes:
Receive Immediately:
A Copy Guide specific to your template, including prompts for using AI tools to write your copy
Website Freebies
Build Your Travel Brand Kit
Brand Design Kit from Your Collection
Social Media Template Kit from the website collection you purchased
What You’ll Receive Throughout the Process:
1 Stylized Website Template (you pick the collection, stylize = color palette, logo, and font selection application)
One-Page Brand Style Guide (based on what you submitted)
Up to 10-minute audit of your final website
Social Media Profile Kit — up to 6 highlight covers, a profile photo template, a custom bio written based on your website, and 3 rebrand launch graphics
2. Process & Timeline
Purchase — Client purchases the template collection.
Delivery of digital assets — Client receives an email with links to their purchases: Social Media Templates, the specific Website Copy Guide, the AI Copywriting Guide, the Brand Kit from their collection, and the Build Your Travel Brand Kit.
Project setup — Client is added to the shared Trello board (using the email associated with purchase) and adds TSS as a contributor on Showit.
Brand submission — Client submits their brand assets (logo, color preferences, brand direction) to TSS. This must be submitted within 2 months of purchase.
Styling — Within 10 business days of receiving the Client's brand submission, TSS will style the template: logo placement, color palette application, and font selection. Client also receives their One-Page Brand Style Guide at this stage.
Client build-out — Client receives the styled template and is responsible for plugging in their own images and copy.
Final review — Once the Client has finished building out the site, they send TSS the preview link for the final website audit. This must be submitted within 4 months of purchase. TSS provides one up to 10-minute audit video and a social profile makeover based on the finished site.
The 10-business-day styling window begins once TSS has received all required brand assets from the Client. Delays in submitting brand assets will delay the corresponding timeline.
Submission Deadlines
Brand design submission: must be received within 2 months of purchase.
Final website audit submission: must be received within 4 months of purchase. The audit is a one-time service — if the preview link is not submitted within this window, the audit is forfeited and will not be rescheduled or resubmitted.
3. What's Not Included
To be clear on scope, TSS does not provide the following as part of this Service:
Adding, editing, or sourcing images (outside of logo placement)
Writing, editing, or inserting copy
SEO setup or optimization
Launching or publishing the website
Connecting or attaching a domain
Purchasing a domain or any related subscriptions on the Client's behalf (Client is responsible for all domain and platform subscription costs)
4. Add-On Hours
If Client would like hands-on help launching the site beyond what's included in the Service, additional hours may be purchased separately:
2-hour increment: $140
4-hour increment: $280
Add-on hours must be purchased separately and are scheduled based on TSS's availability at the time of request.
5. Revisions
Styling (adding logo placement, color palette, font selection): 1 round of revisions is included. Additional revisions beyond this may be billed using the add-on hourly rates above.
Social profile makeover: 1 round of revisions is included.
Social media template graphics and brand design materials from your collection: these deliverables are DIY (Client customizes them independently) and are not eligible for revisions from TSS.
6. Client Responsibilities
Client is responsible for:
Submitting complete and final brand assets within the deadlines above
All copywriting and image sourcing/insertion for the final site
Any SEO, domain purchase/connection, hosting, and platform subscription costs
Reviewing and approving the styled template before proceeding to build-out
Submitting the final website preview link within the audit deadline above
TSS is not responsible for delays caused by late or incomplete Client submissions, and is not responsible for services forfeited due to missed deadlines.
7. Payment & Tax
Payment is collected at the time of purchase. Applicable sales tax is calculated and collected at checkout through our payment processors, Flodesk and Stripe.
8. Cancellations & Refunds
Once the Client has been added to the Trello board, no cancellations or refunds will be issued, as the Client has been granted access to the associated digital resources (Social Media Templates, Website Copy Guide, AI Copywriting Guide, Brand Kit, and Build Your Travel Brand Kit) at that point.
If a refund is requested before the Trello board is created and the Client is added, the Client will be charged for:
The individual shop cost of any digital resources already received, plus
A $100 fee to cover freebies and other materials provided between the time of purchase and Trello board addition.
The remaining balance, if any, will be refunded.
9. Ownership & Intellectual Property
The underlying website template, brand kit designs, and associated graphics remain the intellectual property of The Scenic Studio and are licensed to the Client under the terms of our Digital Product License Agreement. Styling work performed by TSS (logo placement, color, and font selection) becomes part of the Client's licensed template for their own business use, subject to that same license.
10. Client Content & Final Product Disclaimer
TSS styles your template based solely on the brand assets you submit (logo, color preferences, and brand direction), and performs the audit based solely on the final website you build. You are solely responsible for the copy, images, personalization, and any other content you add to your website, as well as your final brand design and anything you ultimately publish.
As part of our process, every Client is required to replace template text and photos and add their own personality and content — this Service is not intended to produce an identical or "as-shown" final website. Accordingly, The Scenic Studio is not liable for the final published website, its content, appearance, performance, or any outcomes resulting from Client's own submissions, edits, copy, images, or brand design choices.
11. Indemnification
You agree to indemnify and hold The Scenic Studio harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the templates, including content, images, or copy you provide or insert.
12. Chargebacks & Payment Disputes
By purchasing this Service, you agree not to file a chargeback or payment dispute with your bank or payment processor without first contacting The Scenic Studio directly to attempt to resolve the issue.
13. Limitation of Liability
To the fullest extent permitted by law, The Scenic Studio's total liability for any claim arising from this Service is limited to the amount paid for the Service. We are not liable for indirect, incidental, or consequential damages, including lost profits or business losses.
14. Age Requirement
You must be at least 18 years old to purchase this Service.
15. Dispute Resolution
Any dispute arising out of or relating to this Agreement shall first be addressed informally by contacting The Scenic Studio at hello@thescenicstudio.com. If a resolution cannot be reached informally within 30 days, the dispute shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Forsyth, North Carolina, rather than in court, except that either party may bring an individual claim in small claims court where applicable. You and The Scenic Studio each waive the right to a jury trial and to participate in a class action.
16. Governing Law
This Agreement is governed by the laws of the State of North Carolina, without regard to conflict of law principles.
17. Entire Agreement
This Agreement, together with our Shop Terms & Conditions, Refund Policy, and Digital Product License Agreement, constitutes the entire agreement between you and The Scenic Studio regarding this Service, and supersedes any prior understanding not stated in writing here.
18. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.
